BOCC update (40/10)

20 September 2010

Police Association members occupying positions identified as being within the scope of the BOCC project would be aware that the date for grievances to be lodged with the BOCC project team has now passed.

In accordance with our Industrial Agreement, the Association and the Force can jointly appoint an independent arbitrator to determine any unresolved disputes that arise from this process between members and the employer.

In this regard, the parties have agreed to the appointment of former Superintendent Trevor Parks as the independent arbitrator to determine the grievances arising from Project BOCC.

The process from this point, in relation to grievances which have already been lodged by members, is as follows:

  •         Grievances forwarded from the Local Manager to the Department Head for comment
  •         Grievances reviewed by the BOCC project team, in consultation with Department Head
  •         If grievance is upheld by the BOCC project team the positions in question will be removed from scope and remain as sworn positions
  •         If grievance is rejected by BOCC project team, reasons for the decision will be put in writing and forwarded along with the grievance to the independent arbitrator for determination.

The independent arbitrator will deal with grievances by way of a hearing, with The Police Association acting on behalf of aggrieved members. Members can be called to give evidence and are allowed to sit in on the hearings.

The hearings will be held, where possible, at the closest location to the workplace to enable members to attend the hearings.

It should be noted that the hearings will not commence until November 2010.

If you have not provided the Association with your grievance and you would like us to act on your behalf, please forward your grievance to us via email general@tpav.org.au

Should you wish to discuss this matter further, please contact our IR Section on (03) 9468 2600.
