Swearing of affidavits (66/11)

Members will be aware of a Chief Commissioner’s instruction (CCI) 15/11, as published in the Police Gazette on 7 November 2011, which reinforces the current practice of swearing an affidavit.
This instruction, in essence, requires members involved in a matter that is currently before the courts or pending court that relies on evidence obtained by way of affidavit within the brief of evidence, to complete a form 1407.
Further, members that have been involved in the affidavit process relating to matters previously dealt with and finalised by the courts are required to complete a general declaration form 1407A.
Members can be assured that this instruction was developed in close consultation with The Police Association. We are also assured that members will incur no detriment whatsoever for making such a declaration.
However, failure to make such a declaration prior to the 20 January 2012 cut-off date may expose members to discipline action.
We accordingly encourage members to comply with this Chief Commissioner’s instruction 15/11.
